Living Full-Time in an Unusual Accommodation: What Does the Regulation Say?

First and foremost, it is important to know that in France, any installation intended for housing, even if it's lightweight, is governed by the Urban Planning Code. An unusual accommodation can be used as a year-round dwelling, provided that certain rules are respected, particularly regarding the land and the necessary permits.

The Type of Land

This is one of the most critical points. If you plan to set up an unusual accommodation on a permanent basis, the land must be buildable. This means that it must be located in an area permitted by the Local Urbanism Plan (PLU) of your municipality, and allow the reception of a construction for residential use.

On buildable land, it is entirely possible to install an unusual accommodation to live in year-round, subject to filing:

  • A preliminary declaration of work (generally if the surface area is less than 20 m²),

  • Or a building permit, depending on the dimensions, ground coverage, or local rules.

    On non-buildable land (agricultural, natural areas...), a permanent installation is in principle prohibited. It may sometimes be tolerated in very specific cases, but it does not allow the dwelling to be declared as a main residence.

The Status of the Habitat

As soon as accommodation is installed permanently, with connections (electricity, water, sanitation), and it is occupied more than 8 months a year, it is considered a permanent dwelling. It then falls within the scope of constructions subject to authorization. It is therefore essential to check the zoning of the land, consult the town hall, and file the necessary documents to be in compliance.
